Every few weeks, a message lands on your phone: a new project, "pre-launch price", limited units, pay a small amount to block one. Pre launch projects in Bangalore are marketed hard because they work for developers. Whether they work for you depends on what you are actually paying for, what the law says, and how much risk you can stomach.
This guide explains what pre-launch and EOI bookings are, why prices look lower, where the legal lines are, and how to protect yourself if you decide to go ahead.
What Pre-Launch and EOI Bookings Actually Are
A pre-launch is the period before a project is formally launched for sale. During this window, a developer may collect an Expression of Interest (EOI): a payment, often a few lakh rupees, that supposedly gives you priority to pick a unit once sales open.
In theory, an EOI is not a purchase. You have not signed an agreement for sale, you may not know the exact unit, and the final price is usually "to be confirmed". In practice, many buyers treat it as a booking, and some sales teams describe it that way too. That gap between what it is and what it feels like is where most problems start.
Why Pre Launch Projects in Bangalore Are Priced Lower
Developers have genuine reasons to offer early buyers a lower price:
- Early cash flow: EOI money helps a developer gauge demand and fund early costs.
- Testing demand: strong EOI response can justify pricing or a faster launch schedule.
- Risk premium: you are paying earlier and taking on more uncertainty, so you get a discount for it.
That last point is the important one. The discount is not a gift. It is payment for accepting risk that later buyers will not carry: unclear approvals, an unknown timeline, and a price that might change.
It also helps to compare like with like. A pre-launch quote on super built-up area can look cheaper than a launched project's price simply because the loading is higher. Ask for the carpet area of the exact unit type and work out the price per sq ft of carpet area before you decide the discount is real.
What RERA Says About Selling Before Registration
Under Section 3 of the Real Estate (Regulation and Development) Act, 2016, a promoter cannot advertise, market, book, sell, offer for sale or invite people to buy any plot, apartment or building in a real estate project without first registering it with the state RERA authority. Projects on land up to 500 sq m, or with up to eight apartments, are generally exempt.
So for a typical Bangalore apartment or plotted project, collecting money for units before RERA Karnataka registration sits on the wrong side of this rule. Section 59 allows a penalty of up to 10% of the project's estimated cost for violating Section 3, and RERA Karnataka has publicly flagged unregistered projects under investigation on its website.
There is a second protection. Section 13 says a promoter cannot take more than 10% of the cost of a unit as an advance or application fee without first signing and registering an agreement for sale with you.
Developers often argue that an EOI is a refundable, non-binding expression of interest and therefore not a booking. Whether that holds depends on the facts, including what was promised, what was paid and how it was marketed. Do not rely on the label alone. Our guide on RERA Karnataka check shows how to look up a project's registration.
The Real Risks of Pre-Launch Buying
No approvals yet
Before RERA registration, the developer may not have a sanctioned building plan, environmental clearance or a clean land conversion. Any of these can change the design, reduce the number of floors, or stop the project.
Delays before construction even starts
Possession timelines are only enforceable once they are declared under RERA. Before that, a project can sit in pre-launch for months or longer while approvals move, and your money sits with it.
Refund trouble
If the EOI terms are verbal, vague or simply say "adjustable against booking", getting your money back can be slow. Without RERA registration, you also lose the faster RERA complaint route for that project, and may have to rely on consumer forums or civil courts.
Price and unit uncertainty
The "pre-launch price" may only apply to certain floors or facings, or may be quoted on super built-up area with loading you have not seen. When sales open, the unit you wanted may be priced differently or allotted to someone else.
Land title issues
Some pre-launch projects are on land still under joint development negotiation, partition, or conversion. If the title is not clean, the whole project is exposed.
How to Protect Yourself
If you still want to explore a pre-launch offer, take these steps before you pay anything:
- Get the EOI terms in writing, on the developer's letterhead, stating the amount, that it is fully refundable, the refund timeline, and that you are under no obligation to buy.
- Pay only by bank transfer or cheque to the developer's company account, never cash, and keep the receipt.
- Ask for the RERA application status and the expected registration date. A credible developer will tell you.
- Check the land documents: title deed, encumbrance certificate, conversion order, and any joint development agreement with the landowner.
- Check the developer's track record: visit completed projects, ask residents about delays and quality, and search RERA Karnataka for complaints.
- Keep the amount small and do not sign any agreement for sale until the project is RERA-registered and you have the approved plan.
- Re-check the price at launch. Compare it against similar RERA-registered projects nearby before you convert your EOI.
When a Pre-Launch Can Make Sense
Pre-launch bookings are not always a bad idea. They tend to be more reasonable when:
- The developer has a long, clean record in Bangalore of delivering close to promised dates.
- The land is owned outright by the developer or under a registered joint development agreement, with conversion done.
- The EOI is genuinely refundable, in writing, with a short refund window.
- You are not stretching your finances and can afford to have the money locked up for a while.
- The price advantage is meaningful compared to registered projects in the same micro-market, not just a few hundred rupees per sq ft.
If even two of these are missing, it is usually wiser to wait for RERA registration. You may pay a little more, but you get approved plans, a declared possession date and legal recourse. Our guide on ready-to-move vs under-construction homes covers that trade-off further.
Frequently Asked Questions
Are pre-launch projects legal in Bangalore?
Under Section 3 of the RERA Act, a covered project cannot be advertised, marketed, booked or sold before RERA registration. Developers sometimes collect refundable EOIs before launch, but you take on more risk and fewer legal protections when you pay before registration.
Is EOI money refundable?
Only if the written terms say so. Get the refund condition and timeline in writing before paying, and avoid any EOI described as non-refundable or adjustable only against a booking.
How much discount do pre-launch projects offer?
It varies by developer and location, and there is no standard figure. Compare the offered price with RERA-registered projects nearby on a carpet-area basis to judge whether the discount is real.
How do I check if a project is RERA registered in Karnataka?
Search the project or developer name on the RERA Karnataka website. A registered project will show its registration number, approved plans, and declared completion date.
What should I do if a developer refuses to refund my EOI?
Send a written demand with your payment proof and the EOI terms. If that fails, you can approach the consumer commission or take legal advice; if the project later registers with RERA, a complaint to RERA Karnataka may also be possible.
If a pre-launch offer has reached you and you want a second look, Skyros Estates can check the land documents, the developer's track record and RERA status before you pay anything.
