A finished building with painted walls and working lifts can still be, legally speaking, not ready to live in. That is what the occupancy certificate decides. For anyone buying a flat in Bangalore, especially a ready-to-move or resale one, the occupancy certificate in Bangalore affects your electricity and water connection, your home loan, your khata and your ability to sell later.
This guide covers what the OC is, how it differs from a CC, what a partial OC means, how to check one, and what you can do if a builder keeps delaying it.
What is an occupancy certificate in Bangalore?
An occupancy certificate (OC) is issued by the planning authority once a building is complete. It confirms the building was constructed as per the sanctioned plan and meets the required safety norms, including fire safety for taller buildings, and that it is fit to be occupied.
Within city limits, OCs used to come from BBMP. Since 2025, the city is governed by the Greater Bengaluru Authority (GBA) and its five city corporations, which now handle building plan approvals and OCs. Outside those limits, the authority depends on location, for example a local planning authority under BMRDA or the BDA for its own layouts.
OC vs CC: clearing up the confusion
"CC" means two different things depending on who you ask, which is why people get confused.
- In Bengaluru's building approval system, CC usually means the Commencement Certificate, the permission to start construction after the plan is sanctioned. It comes at the start of a project.
- In many other states, and in some legal documents, CC means the Completion Certificate, issued when construction is done.
- The OC comes at the end and confirms the building can be occupied.
For a Bangalore apartment, you want to see the sanctioned plan, the commencement certificate and the occupancy certificate. Utility companies have started asking for both the CC and the OC.
Why the OC matters so much now
Electricity and water connections
In December 2024, the Supreme Court said essential services such as electricity, water and sewerage connections should not be given to buildings without a valid completion or occupancy certificate. Following this, the Karnataka Electricity Regulatory Commission directed electricity supply companies including BESCOM to insist on these certificates for new connections. Without an OC, a building can be stuck on temporary or construction-stage power, which usually costs more.
In 2025 the state brought in relief for small individual houses on smaller plots, generally ground plus two floors, exempting them from the OC requirement. That relief does not cover apartment buildings, which still need an OC. These rules have moved several times, so check the latest before you buy.
Home loans
Most banks will not finance a ready flat in a building without an OC, and the same Supreme Court ruling flagged lending to such buildings. For under-construction flats, banks look at the RERA registration and plan sanction instead, but they will ask about the OC before final disbursement or for a resale purchase.
Khata and property tax
A separate khata for your flat, now issued as an e-Khata through e-Aasthi, generally depends on the building having an OC. Without a proper khata, resale and future loans get harder. Our guide on A, B and e-Khata explains how this works.
Legality and resale
Occupying a building without an OC can expose owners to penalties and, in the worst case, action against unauthorised floors or deviations. Even if nothing happens, the next buyer's bank will ask for the OC, and its absence can knock a lot off your sale price.
What is a partial OC?
Large Bangalore projects are often built in phases, with several towers. Authorities can issue a partial OC for completed blocks while the rest is still under construction. This is legitimate and common.
- Check that your specific tower or block is named in the partial OC.
- Confirm that common facilities you rely on, such as the main access road, STP and fire systems, are covered or functional.
- Expect ongoing construction noise and dust if later phases are still being built.
How to check OC status for a Bangalore project
- Ask the builder for a copy of the OC and the sanctioned plan. A genuine developer will share it without fuss.
- Check the RERA Karnataka project page. Developers upload approvals and completion documents there. Our guide on how to check a project on RERA Karnataka walks through the steps.
- Search the authority's records. The GBA building plan approval system has published lists of issued OCs, and older BBMP OCs can be found in its archived records. Search by project name, address or OC number.
- Visit the zonal office if you can't find it online, with the property details.
- Match the details. The OC should show the same survey number, number of floors and number of units as the sanctioned plan and your sale agreement. Extra floors that aren't in the OC are a warning sign.
Risks of buying a flat without an OC
- Temporary utility connections, or difficulty getting permanent ones in your name.
- Difficulty getting a home loan now, and a smaller pool of buyers when you sell.
- Delays in getting a khata for your flat, which blocks other paperwork.
- Possible penalties if the building deviates from the approved plan.
- A builder who has been paid in full has less reason to finish pending work.
Some buyers take a discount and buy anyway. If you do, go in with eyes open, a lawyer's opinion and a clear written commitment from the builder on when the OC will come. Our ready-to-move vs under-construction guide covers this trade-off.
What to do if the builder delays the OC
Under the RERA Act, obtaining the occupancy or completion certificate is the promoter's responsibility under Section 11(4)(b). The Act also expects buyers to take possession within two months of the OC and the conveyance to be completed within three months of it. If your builder hands over keys without an OC, or keeps pushing the date, you have options.
- Write to the builder asking for the OC status, application number and expected date. Keep everything in writing.
- Talk to other buyers in the project. A collective complaint carries more weight, and an association can follow up on common issues.
- File a complaint with RERA Karnataka under Section 31, online through the RERA Karnataka portal (Form N). You can seek directions to obtain the OC, interest for delayed possession, or a refund if you choose to withdraw.
- Know what interest you can claim. For delayed possession, Karnataka RERA orders have typically awarded interest at the SBI marginal cost of lending rate plus 2 percent. Penalties against promoters who breach Section 11(4)(b) can go up to 5 percent of the project cost.
A complaint doesn't produce an OC overnight, but it creates pressure and a formal record, which helps if you later need compensation.
Frequently Asked Questions
Can I register a flat in Bangalore without an OC?
Sale deeds have been registered for flats without an OC, but doing so leaves you exposed on utilities, loans, khata and resale. It is much safer to register after the OC is issued, or with a strong written commitment from the builder.
How long does it take to get an OC in Bangalore?
There is no single timeline. It depends on the size of the project, inspection schedules and whether there are deviations to sort out. For a large project it can take several months after construction ends.
Is an OC needed for a resale flat?
Yes. Ask the seller for a copy. If the building never got one, expect problems with the buyer's loan and the khata, and price that risk in.
Does an independent house need an OC in Bangalore?
Under the 2025 relief, many small individual houses within GBA limits are exempt, subject to conditions on plot size and floors. Larger houses and all apartment buildings still need one. Check the current rules for your plot.
If you are weighing a ready flat and want someone to check the OC, plan sanction and RERA records before you go further, Skyros Estates can help with shortlisting, site visits and those first document checks.
