A well-drafted rental agreement in Bangalore is the cheapest protection a landlord can buy. It costs a few hundred rupees in stamp duty, and it decides who pays for a leaking geyser, how much of the deposit comes back, and what happens if the tenant stops paying in month seven.

This guide is for owners renting out a flat or house in Bangalore. It covers the choice between an 11-month agreement and a registered lease, stamp duty and e-stamp paper, the clauses worth adding, tenant police verification, the state of tenancy law in Karnataka, and the tax side. Rules change, so check the latest before you sign.

11-Month Agreement or Registered Lease?

Most residential rentals in Bangalore run on an 11-month leave and licence or rental agreement, renewed each year. The reason is legal, not tradition. Under the Registration Act, a lease from year to year or for more than one year must be registered. Keeping the term under 12 months means registration is optional, so you skip the trip to the sub-registrar and the registration fee.

When an 11-month agreement makes sense

  • Standard family or working-professional tenancy where you expect to renew annually
  • You want the flexibility to revise rent or end the arrangement at renewal
  • Lower stamp duty and no compulsory registration

When a registered lease is worth it

  • Longer corporate leases of two to five years, where the company insists on registration
  • High-value rentals, where you want the strongest possible evidence in court
  • Any lease of 12 months or more, which must be registered to be fully enforceable

Registered leases are booked through the Kaveri 2.0 portal and executed at the sub-registrar's office. Stamp duty depends on the lease term and is calculated on rent plus deposit and other amounts, so it is noticeably higher than for an 11-month agreement.

Stamp Duty and E-Stamp Paper in Karnataka

Under Article 30 of the Karnataka Stamp Act, a residential lease of up to one year attracts duty of 0.5% of the rent, advance and other amounts, subject to a cap of ₹500. In practice, many 11-month agreements in Bangalore are executed on ₹100 to ₹500 of stamp paper depending on the amounts involved. Longer leases attract percentage-based duty that rises with the term. These figures are approximate and are revised from time to time, so confirm the current rate before you print.

Karnataka uses e-stamp paper, issued through Stock Holding Corporation of India (SHCIL) and its authorised collection centres, including many banks and stationery shops. A few practical points:

  • Buy the e-stamp in the name of one of the parties, usually the tenant or landlord, with the correct description (lease or rental agreement).
  • Print the full agreement on the e-stamp paper or attach it as the first page, and have both parties and two witnesses sign every page.
  • Online services can draft and deliver a stamped agreement to your door, which is handy if the tenant is relocating from another city.

Unstamped or under-stamped agreements aren't void, but a court can refuse to admit them as evidence until duty and a penalty are paid. It is not worth saving a few hundred rupees here.

Clauses to Include in a Rental Agreement in Bangalore

Template agreements from the internet often miss the points that actually cause disputes. Make sure yours covers these clearly.

  1. Security deposit: the amount, that it is refundable without interest, the deductions allowed (unpaid rent, damage beyond normal wear and tear, pending bills) and how many days after handover you will refund it. Bangalore landlords have traditionally asked for large deposits, sometimes several months' rent; tenants increasingly push back, so be reasonable and write it down.
  2. Rent and due date: monthly rent, due date, mode of payment, and a late payment charge if you want one.
  3. Rent escalation: the percentage increase on renewal. Around 5% to 10% a year is common in Bangalore; state the exact figure.
  4. Lock-in period: a minimum period, often three to six months, during which neither side can exit without paying the rent for the remaining lock-in.
  5. Notice period: usually one or two months from either side after the lock-in.
  6. Maintenance charges: whether the society or association maintenance is included in rent or paid separately by the tenant.
  7. Utilities: electricity (BESCOM), water (BWSSB) and gas are normally the tenant's responsibility; take meter readings at handover.
  8. Repairs: minor repairs such as bulbs, taps and small plumbing on the tenant; structural repairs and major appliances on the landlord.
  9. Painting and cleaning charges: whether a fixed painting or deep-cleaning charge will be deducted at exit. Spell out the amount or method, as this is one of the most common deposit disputes.
  10. Use and occupants: residential use only, no subletting, a pets clause, and the names of people who will live there.
  11. Inventory list: every fitting and appliance, with photos, signed by both sides as an annexure.

Police Verification of Tenants in Bangalore

Bengaluru City Police ask landlords to share tenant details with the local police station before or soon after the tenant moves in, and police stations periodically issue advisories reminding owners to do this. It helps police trace people in case of crime and protects you if the tenant turns out to have given false details.

You can collect the tenant information form from the jurisdictional police station or from the Karnataka State Police website, and some services can also be accessed through Bangalore One and Karnataka One centres. You will need:

  • The tenant's photo and ID proof, such as Aadhaar or passport
  • Their permanent address and previous address
  • Your ownership proof and ID
  • The rental agreement

Keep the acknowledgement. Many apartment associations also insist on it before allowing a tenant to move in. Our guide on renting vs buying for IT professionals looks at the market from the tenant's side.

Tenancy Law in Karnataka: Where Things Stand

Rentals in Karnataka are governed by the Karnataka Rent Act, 1999. The central government circulated the Model Tenancy Act in 2021, which proposes rent authorities and a cap of two months' rent on residential deposits. As of late 2026, Karnataka has not adopted it as a new law.

What Karnataka did do is pass the Karnataka Rent (Amendment) Act, 2025, which came into force in January 2026. Its main change is to replace criminal penalties under the 1999 Act with a fine-based system decided by the Rent Controller. You may see articles online saying Karnataka now caps deposits at two months or forces every agreement to be registered within a set time. Primary legal sources we checked don't support that clearly, so check the current position with a lawyer before you rely on any of it.

TDS on Rent and Tax on Your Rental Income

TDS when rent is above ₹50,000 a month

If an individual or HUF tenant pays rent of more than ₹50,000 a month, the tenant must deduct TDS before paying you. This was Section 194-IB of the old Income-tax Act; from 1 April 2026 it sits under Section 393 of the Income-tax Act, 2025, and the rate for this category is 2%. The tenant deposits it using Form 26QC and gives you a TDS certificate.

As the landlord, share your PAN with the tenant. Without it, TDS can be deducted at a much higher rate. Check that the TDS shows up in your Form 26AS or annual information statement each year.

Tax on rental income

Rent is taxed under the head 'income from house property'. The calculation is straightforward:

  1. Start with the annual rent received.
  2. Subtract municipal property tax you actually paid during the year.
  3. Subtract a flat standard deduction of 30% of the remaining amount, which covers repairs whether or not you spend on them.
  4. Subtract home loan interest on that property, within the limits that apply to your tax regime.

What is left is added to your income and taxed at your slab rate. Separate maintenance charges collected from the tenant and passed to the association are usually not treated as your rent if the agreement makes this clear. Speak to a CA if you own several properties or have a joint loan.

Frequently Asked Questions

Is registration of an 11-month rental agreement mandatory in Bangalore?

No. Leases of less than one year don't need compulsory registration under the Registration Act. It must still be on correctly valued stamp paper to be admissible as evidence.

How much stamp paper is needed for a rental agreement in Bangalore?

For a residential agreement of up to one year, duty is 0.5% of rent and advance, capped at ₹500, so most agreements need ₹100 to ₹500 of e-stamp paper. Confirm the latest rate when you buy.

Is tenant police verification compulsory in Bangalore?

Bengaluru City Police ask landlords to share tenant details with the local station, and many associations insist on it. It takes little time and protects you, so treat it as essential.

Do I need to pay tax if the tenant deducts TDS?

Yes. TDS is only an advance. You still declare the full rent in your return, pay tax at your slab rate after deductions, and claim credit for the TDS.

Has Karnataka adopted the Model Tenancy Act?

Not as of late 2026. Karnataka still follows the Karnataka Rent Act, 1999, as amended in 2025 to decriminalise offences. Check the latest before you draft deposit or eviction clauses.

A clear agreement and a well-chosen tenant save far more than they cost. If you are planning to rent out a flat, Skyros Estates can help you set a realistic rent, find tenants and keep the paperwork in order.
